This is why we are committed to protecting your privacy and using the information you share with us responsibly to better serve you. INFORMATION COLLECTED

Burlington and its third party service providers collect Information about you from a variety of sources, including Personal Information you provide directly to us, and information we collect about you when you access and use our Site or shop in our stores. We may combine any of the Information collected about you for the purposes described in this Privacy Policy.

• Identifying information: We may collect your personal Information such as your name, online identifier, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), mailing addresses, email address(es), phone numbers, internet protocol address, email address, account name, Social Security number, driver’s license number, passport number, and other similar identifiers;
• Social Media: When you interact with, or if you are a fan/follower of, Burlington on social media, we may receive information such as your user ID, handle, your profile picture, photos you post, and other profile elements, including any comments, with us. Note that your use of social media is are subject to the terms and conditions and privacy policies of each respective social media platform, and the information you share with us and with others is largely controlled by the privacy settings you have established at those platforms.
• Information you submit: we may collect preference information, or survey answers/opinions, which you submit to us in connection with various marketing and promotional activities, surveys or contests conducted in our stores;
• Demographic Information: we may collect your education level, income level, birthdate, gender, marital status, number of children and their ages, and zip code.
• Payment information: we may collect your signature, bank account number, credit card number, debit card number, billing address and other financial information.
• Geolocation: we may collect precise location information from your device.
• Commercial Information: we may collect information about the products you purchased or considered purchasing from us, as well as your other purchasing or consuming histories or tendencies.
• Online and Internet Activity: We may also collect your Internet and other electronic network activity information, including, but not limited to, your internet service provider’s address, information about the browser you are using when visiting our Site or we may look at what Site you came from, or what Site you visit when you leave ours, other browsing history, , information regarding your interaction with websites, applications or advertisements, and the language and time zone settings on your web browser;

HOW WE COLLECT INFORMATION

• When you return or exchange a product you purchased,

• When visiting our stores we may capture audio, electronic, visual, thermal or similar information with our anti-theft surveillance equipment,

Automatically:

• Cookies: Cookies are small text files stored by your browser that allow us to learn more information about your visit or use of our Site. We may use cookies to remember your Personal Information to track your usage of our Site over time. Most browsers automatically accept cookies. You have the choice to set your browser to accept or reject cookies. Each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences.
• Analytics Information: We may use third-party analytics tools, such as Google Analytics, to help us measure traffic and usage trends for our Online Services. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving our Site and providing you a more personalized experience.
• Device and Browsing Information: We collect certain information about your computer or device each time you access our Site.  Servers may automatically record certain log file information such as your web request, Internet Protocol (IP) address, MAC address, physical location data, browser type, referring / exit pages and URLs, number of clicks and how you interact with Linked Sites, domain names, landing pages, pages viewed, and other such information.
• Clear Gifs/Web Beacons: When you use our Site we may employ clear gifs (also known as web beacons) which are used to track your online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information facilitates more accurate reporting and improvement of our Site.
• Location Data: When you access our Site via a mobile device, we may access, collect, monitor, and/or remotely store information regarding your mobile device, as well as real-time “location data,” which may include GPS coordinates. Location data may convey to us information about how you browse and use our Site. You may opt-out from allowing us to have access to your location data by adjusting the permissions in your mobile device, though some features of our Site may not function properly if use or availability of location data is impaired or disabled.
• Information We Receive From Third Parties: We may receive Information about you from third parties. • Information you provide at our retail stores may be combined with information that you provide online at the Site, as well as with information about your interests and purchases we collect automatically. • We collect information from other sources, through or in connection with apps or software sponsored by Burlington, or on other websites hosted or sponsored by us. We may combine or cross reference this information with other information that we collect about you to help us improve the quality of your experience with Burlington and tailor communications to your interests.

HOW WE USE THE INFORMATION WE COLLECT

SHARING OF INFORMATION

Burlington shares information about our customers with affiliated companies, vendors, business partners and service providers. These companies need information about you, including your name, address, phone number, email address, to perform their service function (such as to process your payment and fulfill your order, verify your credit card information, and to protect you and us from fraud). We may also share your information with third parties such as those that provide financial products and services related to our business and those that co-sponsors our contests, events or other promotions. We also share your information, including your name, address, phone number, email address, and shopping preferences, with specially chosen companies that help us with marketing functions (such as manage our Internet business, maintain and manage our customer information, as well as market our products and services). We may display information you choose to post on our Ratings & Reviews feature. At times we may share information with other companies that have a product or service that we believe will be of interest to you and/or may help them serve you better. We may engage vendors to serve advertisements on our behalf across the Internet and to provide analytics services. We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on certain of our Online Services. Google Analytics uses cookies to collect information such as how often you visit our Site, what pages you visit within our Site, and what other sites you visited prior to coming to our Site. We use the information provided by Google Analytics to improve our Site and services. This Site may include job postings from time to time for Burlington job opportunities at its store locations, distribution centers, and corporate offices. Should you wish to do so, you may apply for such job openings online through an applicant tracking system operated by iCIMS by creating an applicant profile and submitting an application via the Site, which information is usually received by Burlington’s human resources department. Once submitted, your application, resume or CV (if applicable), and other personal information (collectively, “Applicant Information”) may also be made available to additional human resources personnel and/or hiring manager(s) at the Burlington location to which you are applying. In addition, your Applicant Information will be stored in that tracking system in an electronic database maintained by iCIMS on behalf of Burlington.

All such Applicant Information may be used by Burlington for the purpose of assessing your suitability for current and future job opportunities and to assist with Burlington’s recruitment and application processes.

As discussed above, as part of the application process, you will be required to create an applicant profile with a user name and password. You are solely responsible for maintaining the confidentiality of that username and password, and for any unauthorized access or use of your user name and password.

You may review, update, correct or delete your online account information at any time by contacting us to request changes to any of your information. We will respond to your request consistent with applicable law. Customers who no longer wish to receive our promotional materials may opt-out of receiving these communications by clicking the unsubscribe link at the bottom of the email or contacting customer service. If you want to update information in the iCIMS tracking system, please contact iCIMS as noted in their privacy policy. In some cases, we may need to retain and use personal information obtained previously to verify your identity and as otherwise required or permitted by applicable law.

When required in your jurisdiction, Burlington will permit individuals to access, correct, amend or delete Personal Information that is demonstrated to be inaccurate or incomplete. We may also enter into agreements with third parties that possess technology that allows the Site to use targeting or advertising cookies to see which areas and features are popular, count visits to our website and customize the advertising and marketing messages you receive on the Site. This information may be shared with these third parties for this purpose.

We also provide interest-based advertising about our products and services on other parties’ websites. However, if and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for interest-based advertising, we will comply with applicable law as to such activity.

If you make a Request to Delete, we may ask you to confirm your request before we delete your personal information.

Authorized Agents

If you want to make a request as an authorized agent on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request that you provide, as applicable, the following:

• Proof of your registration with the California Secretary of State to conduct business in California; and
• A power of attorney from the California resident pursuant to Probate Code sections 4121-4130465 or written permission that the California resident has authorized you to make a request on the resident’s behalf. This permission must be signed (via physical or e-signature) by the California resident.

If you are making a Request to Know or a Request to Delete on behalf of a California resident and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4121-4130, we may also require the resident to:
